This document is provided in multiple languages for your convenience. In case of any conflict or difference between language versions, the English text shall prevail.

Please read these Terms of Use ("Terms") carefully before using the SwapMap mobile application ("App", "Service"). By downloading and using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

1. Definitions

• App: The SwapMap mobile application and related websites
• Developer / We / Us / Our: iCat Studios
• User / You / Your: The person who uses the App
• Service: All features and content offered by the App
• Content: Listings, offers, messages, ratings, profile data, collection inventory, and all other in-app data
• Listing: A user-published advertisement to swap, sell, or request stickers or trading cards
• Offer: A proposal exchanged between users to complete a trade or sale

2. Nature of the Service — IMPORTANT

2.1 SwapMap Is a Community Marketplace, Not a Seller

SwapMap is a peer-to-peer community platform that connects collectors of physical sticker albums and trading cards (such as Panini, Topps, Match Attax, FIFA Adrenalyn XL, and similar series). The following points constitute the fundamental nature of the App and must be clearly understood by users:

• SwapMap does not sell stickers, trading cards, packs, or any physical merchandise.
• SwapMap is not a party to any transaction, swap, or sale between users.
• SwapMap does not hold, escrow, ship, deliver, authenticate, grade, or guarantee the condition of any item exchanged between users.
• SwapMap does not process payments between users. Any money that changes hands between users is exchanged directly between them, off-platform.
• SwapMap does not guarantee that any user will fulfill the terms of an agreed-upon swap or sale. Trades are conducted on the basis of mutual trust and the user-rating system the App provides.

You acknowledge and agree that all transactions, agreements, exchanges, meetings, and disputes arising between users are solely between those users, and that SwapMap is merely a facilitator providing communication tools, search, and discovery features.

2.2 No Gambling, Lotteries, or Games of Chance

• The App contains no betting, gambling, lottery, or game-of-chance mechanics.
• Pro membership and other paid features do not affect search results, trade outcomes, ratings, or any user's competitive standing in any way.

2.3 Age Restriction

The App is intended for users over the age of 13. Persons under the age of 13 may not use the App. By using the App, the user represents that they are over the age of 13. For users between 13 and 18, trades and in-person meetings should be supervised by a parent or guardian.

3. Account Creation and Use

3.1 Creating an Account

To use the App, you must create an account using either Sign in with Apple or Sign in with Google. When creating an account:

• You must provide accurate and current information
• You may not create an account using someone else's identity
• You may not create an account using false or misleading information
• A person may only have one account

3.2 Account Security

You are solely responsible for all activities that occur under your account. To maintain account security:

• You must safeguard your Apple ID or Google account
• You must not allow others to access your account
• You must inform the Developer immediately of any suspicious activity

3.3 Account Termination

The Developer reserves the right to suspend or terminate any user's account without prior notice in the following cases:

• Breach of these Terms
• Fraud, scams, or misrepresentation of items in listings or offers
• Harassment, insults, threats, or hate speech directed at other users
• Repeated trade failures, no-shows, or non-delivery of agreed items
• Creating multiple accounts
• Use of automated software, bots, or scraping tools
• Behavior contrary to applicable laws

4. Acceptable Use

4.1 Listing and Trade Conduct

When you publish a listing, make an offer, or message another user:

• Describe items accurately, including their condition (mint, near-mint, played, damaged)
• Honor the terms of any offer you accept (deliver the items you agreed to deliver, in the condition you described)
• Communicate respectfully and in a timely manner
• Meet in safe, public locations when arranging in-person swaps, especially when minors are involved
• Do not use the App to sell, advertise, or solicit items unrelated to sticker and trading-card collecting

4.2 Prohibited Behavior

The following behaviors are prohibited when using the App:

• Creating fake accounts or impersonating others
• Posting fraudulent listings, fake items, counterfeit stickers/cards, or stolen merchandise
• Using inappropriate display names, profanity, insults, harassment, racist, sexist, or hateful language against other users
• Sending spam, advertising, or promotional content via messages or listings
• Sharing personal contact information of other users without their consent
• Selling or trading any item that is illegal to sell where you live (e.g. stolen goods, regulated items)
• Using the App to launder money or transfer value disguised as a swap
• Attempting to circumvent the App's security mechanisms
• Reverse engineering, decompiling, or disassembling the App
• Copying, distributing, or commercially exploiting App content without permission
• Attempting actions that overload servers or disrupt the Service
• Using automated tools (bots, scripts) to create listings or send offers

4.3 Reporting and Rating

The App provides a rating system and a reporting mechanism. You agree to use these tools in good faith. False, retaliatory, or abusive reports and ratings are themselves a violation of these Terms.

4.4 Sanctions

If such behaviors are detected, the Developer reserves the right to suspend the user's account, hide their listings, remove ratings, or permanently delete the account without prior notice.

5. Intellectual Property Rights

5.1 Ownership of the App

The SwapMap name, logo, visuals, design, source code, and the original content of the App are the intellectual property of iCat Studios. These contents are protected by:

• Copyright
• Trademark registration
• Trade secrets
• Other applicable intellectual property rights

5.2 Third-Party Trademarks and Collectibles

The App displays sticker codes, card numbers, set names, player names, team names, league names, and similar identifiers to help users describe physical items they own or are looking for. These names and the trademarks they relate to are the property of their respective owners — including but not limited to Panini Group, Topps, Match Attax, FIFA, UEFA, individual football clubs, national federations, and the players themselves.

SwapMap does not claim ownership of, does not license, does not resell, and does not distribute any third-party trademark, sticker, card, image, or copyrighted material. All third-party names and trademarks are used solely for identification and descriptive purposes under the principle of nominative fair use, so that collectors can refer to and exchange the items they already physically own.

SwapMap is not affiliated with, endorsed by, sponsored by, or in any way officially connected to any league, federation, club, competition, sticker manufacturer, trading-card publisher, or organization referenced in the App.

You agree that:

• You will not use the App to infringe on the intellectual property rights of any third party
• You will not upload counterfeit, pirated, or unauthorized copies of any sticker, card, or other collectible
• Any commercial use of third-party content displayed in the App requires you to obtain your own license or authorization directly from the relevant rights holder

If you are a rights holder and wish to report unauthorized use of your trademark or copyrighted material within the App, please contact us at the address in section 13. We will respond to legitimate takedown requests within thirty (30) days and remove or replace the disputed content where appropriate.

5.3 User Content

Content you create while using the App (listings, descriptions, photos, display name, messages, ratings) is your property. However, by using the App, you grant the Developer a free, worldwide, royalty-free, non-exclusive, and transferable right to display, store, reproduce, and share this content within the App and with other users for the purpose of operating the Service.

6. Disclaimer

6.1 Service Provided "As Is"

The App is provided "as is" and "as available". The Developer makes no warranties regarding:

• That the App will operate error-free, uninterrupted, or securely
• That listings, ratings, or user information will always be accurate, current, or genuine
• That there will be no server outages
• That the App will work on a specific device or operating system

6.2 User-to-User Transactions

The Developer is not a party to any transaction between users and bears no responsibility for the outcome of any swap, sale, meeting, or agreement initiated through the App. This includes, but is not limited to:

• Non-delivery, late delivery, or partial delivery of swapped items
• Misrepresented condition, authenticity, or grade of swapped items
• Counterfeit, fake, or stolen items exchanged between users
• Damages or losses arising during shipping, packaging, or in-person handover
• Disputes about cash amounts agreed off-platform
• Disputes about meeting locations, times, or in-person conduct
• Personal injury, harassment, theft, or any other harm arising from in-person meetings

Users are solely responsible for verifying the identity, reputation, and trustworthiness of any party they choose to trade with, including by reviewing their rating history within the App. Users meet, trade, and transact at their own risk.

6.3 Limitation of Liability

The Developer is not responsible for direct, indirect, incidental, special, or consequential damages arising from or related to the use of the App. This includes, but is not limited to:

• Loss of, or damage to, any sticker, card, or other physical item
• Money or value lost in a transaction between users
• Data loss
• Material or moral damages
• Personal injury arising from in-person meetings between users
• Device malfunctions
• Third-party service disruptions

7. Apple and Google Disclaimer

7.1 Regarding Apple Inc.

This App is distributed through the Apple App Store for the iOS version. In this context:

• Apple Inc. bears no responsibility whatsoever for this App or its content
• Apple cannot be held responsible for App malfunctions, errors, transactions between users, or any other matter
• Apple Inc. has no obligation whatsoever if the App violates these Terms of Use
• Maintenance, support, and user services for this App are solely the responsibility of iCat Studios
• Apple Inc. is exempt from any liability for legal issues or claims arising within the App
• The App and its content must respect Apple's intellectual property rights
• Users of the App cannot direct any claims directly against Apple Inc.
• Apple Inc. is a third-party beneficiary of these Terms and may enforce these Terms when necessary

7.2 Regarding Google LLC

This App is distributed through the Google Play Store for the Android version. In this context:

• Google LLC bears no responsibility whatsoever for this App or its content
• Google cannot be held responsible for App malfunctions, errors, transactions between users, or any other matter
• Maintenance, support, and user services for this App are solely the responsibility of iCat Studios
• The Google Play Store is solely a distribution platform for the App and bears no responsibility for the content or operation of the App

7.3 Apple Sign-In and Google Sign-In

The App uses Apple Sign-In and Google Sign-In services for authentication. The operation, maintenance, and security of these services belong to the respective service providers. The Developer cannot be held responsible for any disruptions or issues with these services.

8. Paid Features and Subscriptions

The App offers paid features under "SwapMap Pro" or similar names:

• All payments are processed through the Apple App Store or Google Play Store (subscription management is handled via RevenueCat as our reconciliation provider; we do not see or store your payment card information).
• Payment, refund, and subscription management are subject to the policies of the respective platform.
• Refund requests must be submitted to Apple or Google — refund requests cannot be sent directly to the Developer.
• Pro subscriptions auto-renew at the end of each billing period unless canceled at least 24 hours before the renewal date. You can manage and cancel your subscription at any time from your Apple ID or Google Play account settings.
• Pro features only provide users with additional experience — they do not affect the integrity of the marketplace, the visibility of any listing, or the outcome of any swap.
• Pro features do not guarantee successful trades — all users participate in the marketplace on equal terms.

9. Location Services

The App uses your device location only when you grant the corresponding permission, and only at the moments described in our Privacy Policy. We apply a ~500 meter random offset to any stored coordinates so that your exact location is never shared with other users or shown on the public map.

10. Service Modification or Termination

The Developer may, at any time and for any reason:

• Modify, add, or remove App features
• Temporarily suspend the App
• Terminate the App entirely
• Discontinue the Service in certain regions

Users may not claim any compensation due to such changes.

11. Changes to These Terms

The Developer reserves the right to update these Terms of Use at any time. Significant changes will:

• Be published on this page
• Refresh the "Last updated" date at the top
• May be sent as in-app notifications

Continuing to use the App after the changes are published means you accept the updated Terms.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of Türkiye. Any disputes arising from or related to these Terms shall be resolved by the Istanbul Courts and Enforcement Offices.
